    Terms and Conditions

    Last updated: April 2025

    1. Acceptance of Terms

By accessing and using the HoliSpot platform (holispot.com), you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services. We reserve the right to modify these terms at any time – we will notify you of changes through the platform, and continued use constitutes acceptance of any modifications.

    2. Description of Services

HoliSpot is an online platform connecting clients with holistic wellness practitioners. The platform enables searching for practitioners by method and location, online booking and appointment management, online payments via Stripe and cash payments at the time of service, communication between clients and practitioners, practitioner profile and mini-website management, publishing blog articles, courses and e-books, and organizing and managing events and workshops. HoliSpot is not a healthcare provider – it acts solely as an intermediary connecting clients with independent practitioners.

    3. User Accounts

To use the platform's services, you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your login credentials and for all activity conducted under your account. Each user may have only one account. Practitioners register through an application that is subject to administrator approval.

    4. Bookings and Payments

Appointment bookings are made directly through the platform via the practitioner's availability calendar. Payments can be made by card online through the Stripe payment gateway (minimum amount 15 CZK) or in cash on the day of service, if enabled by the practitioner. Free consultations do not require payment. Bank transfers are not supported as a payment method. Practitioners may adjust the price during booking approval, including setting a complimentary consultation.

    5. Cancellation Policy

Each practitioner sets their own cancellation policy, including the minimum cancellation notice period (in hours before the appointment) and the refund percentage. These terms are displayed on the practitioner's profile and during booking. The platform requires a minimum cancellation notice of 24 hours and a minimum refund of 0%. For timely cancellations, refunds are processed automatically through Stripe.

    6. Practitioner Responsibilities

Practitioners are independent professionals and are solely responsible for the quality, legality, and safety of services they provide. Practitioners must hold valid certifications and licenses, provide accurate and up-to-date service descriptions and pricing, maintain an up-to-date availability calendar, communicate professionally with clients, comply with their own cancellation policies, protect client confidentiality, and maintain appropriate liability insurance. Practitioners may sync their Google Calendar or link Calendly to manage availability.

    7. User Responsibilities

Users must provide accurate and up-to-date information, maintain account security, respect intellectual property rights, use the platform in compliance with applicable laws, and behave respectfully toward practitioners and other users. It is prohibited to post inappropriate content, harass others, attempt to disrupt the platform, or use it for illegal activities.

    8. Subscriptions and Pricing Plans

Practitioners can choose from various subscription tiers (Basic, Professional, Premium) that differ in feature scope and visibility. Subscription payments are made monthly or annually (with a 10% discount) through Stripe. Subscriptions can be cancelled at any time. Credits earned within the platform can be used for educational content (courses, e-books) but not for booking services.

    9. Intellectual Property

All HoliSpot platform content (design, code, logos, text) is protected by copyright. Content created by users and practitioners (blog posts, service descriptions, courses, e-books) remains the property of their authors, but by providing it on the platform, you grant HoliSpot a non-exclusive license to display and distribute it within the platform.

    10. Calendar Integrations

The platform offers the ability to sync with Google Calendar and Calendly. When linking Google Calendar, we access busy/free data to prevent double bookings. We do not store or share calendar data with third parties beyond what is necessary for the booking system to function. You can revoke access to Google Calendar at any time through your Google account settings.

    11. Courses, Events, and Educational Materials

Practitioners can create and sell online courses, e-books, and host events (workshops, retreats) on the platform. Prices are set by the practitioner. After purchasing a course or e-book, you gain access to the content according to the terms set by the author. Events may have limited capacity. Event registration is subject to the terms set by the organizer.

    12. Privacy and Data Protection

We collect and process personal data in accordance with our Privacy Policy and applicable laws including GDPR. For details, please refer to our separate Privacy Policy document.

    13. Limitation of Liability

HoliSpot is not liable for the quality of services provided by practitioners, for damages arising from the use of practitioner services, for content created by users or practitioners, for temporary platform unavailability, or for data loss caused by circumstances beyond our control. HoliSpot's maximum liability is limited to the fees paid by the user in the preceding 12 months.

    14. Termination

You may terminate your account at any time through your account settings. We reserve the right to suspend or terminate accounts for violations of these terms, fraudulent activity, or repeated complaints. Upon termination, access to purchased content may be revoked, though certain data may be retained as required by law.

    15. Governing Law

These Terms and Conditions are governed by the laws of the Czech Republic. Any disputes shall be resolved by the competent courts of the Czech Republic. Consumer rights under applicable consumer protection laws remain unaffected.
